“Affidavit for search warrant” (Filed July 3, Tulsa County District Court) Officer R. Aguila of the Tulsa Police Department: The undersigned affiant, being duly sworn, upon oath deposes and says that the following described property: A .380 caliber handgun or any firearm, including any pistol, rifle, shotgun capable of discharging a projectile composed of any material which may reasonably be expected to cause lethal injury.Ammunition for a .380 caliber handgun and all other ammunition.Gang paraphernalia in the form of paintings, drawings, photographs displaying gang behavior, albums, colored rags, miscellaneous writings, objects, or graffiti depicting gang member names logos, monikers, or slogans containing mention of street gang membership affiliation activity or identity. The location to be searched is an apartment with the address of 7702 South Victor Ave., Building 23 Apartment B.This apartment is located inside the River Chase Apartment Complex.The two-story building where the apartment is located runs east and west and the apartment faces south. The building has a shingled roof and is two-tone with tan over burgundy. The number 23 is displayed on the east side of the building in white numbers with a green background. The apartment has a sliding glass door and a window that faces south. The apartment is located on the bottom floor and is the last apartment to the east. The entrance to the apartment is marked with the letter B and the front door faces west. Your affiant further states: That he is a gang investigator with the Tulsa Police Department and is assigned to the Tulsa County multi jurisdictional gang task force. Your affiant has received training in the recognition and investigation of gang related crimes from the Los Angeles County Sheriff's Department, Oklahoma Gang Investigators Association, ATF, FBI, Association of Oklahoma Narcotic Enforcers, and the National Law Enforcement Institute. Your affront frequently has contact with gang members because he conducts criminal investigations involving street gangs. Your affrant further states: That he has been assisting Joplin Police Department in the investigation of a homicide that occurred on (July 3). That victim, Kendace DeCarlo, was shot and killed with a .380 caliber handgun. Investigator Michael Hobson from Joplin P.D.through investigation determined that the victim was the recently estranged girlfriend of Brian McDaniel. Investigation also revealed that Brian McDaniel had made numerous threats over the phone to kill the victim.On (Dec. 15, 1999) investigator Hobson conducted a double-homicide investigation in Joplin, Missouri where Brian McDaniel was a suspect. Jeel Hobson advised that the case still remains open. Your affront further states: That a drive-by shooting and fire bombing did take place at Brian McDaniel's apartment on (July 8). That responding officers found Brian McDaniel and he refused to cooperate in the shooting investigation by refusing to give consent to officers so that they could retrieve evidence from his apartment in reference to the shooting. Your affrant further states: That Brian McDaniel has been identified by the Tulsa County Gang Task Force as a Blood gang member. That it is his training and experience that gang members carry guns for protection from rival gang members. That investigator Hobson has interviewed Brian McDaniel in the past with other gang associates in Joplin, Missouri. That Brian McDaniel is an ex con and may be armed for protection.. Your affrant further states: That Brian McDaniel has an extensive criminal history with the Tulsa Police Department and has been convicted of felonies in 1997 for selling dangerous drugs and possession of a firearm during commission of a felony.
