Teachers who have taught or who are applicants to teach on the War Emergency Certificate may not be officially placed until the term begins, and it is shown that vacancies ex or which no regularly certified teachers are available. It was also emphasized that the provisional certificate which was held last year by several Wyoming county teachers is no longer being is sued, and all these teachers must now apply for the War Emer gency. Easley, on the complaint of attorney, Howe M. Tanner, of Bluefield, that “there were too many school teachers and school bus drivers on the petit jury,” dismissed all of the fifty jurymen who had been selected to serve in the July term of court, here Monday, Tanner charged that the jury commissioners had not selected the jurors in the manner pre scribed by law, and that it ap peared the list had been selected in order to give employment to employees of the board of educa tion since 28 of the 60 jurors were either school teachers or school bus drivers. His complaint came as the court convened at 9:30 Monday morning to choose a jury for the trial of his client, E. P. Loden, who was to go on trial for his life in the pistol slaying of Melvin “Foots” Bunn. Loden, for mer proprietor of the Eagle Cafe that burned with several other buildings on Pineville’s Main street a few months ago, shot and fatally wounded Bunn at the rear of the case last winter. Logen’s case has been con tinued several times since his arrest, and at the April term of court, Judge Easley definitely set the trial date for this term of court. The case was docketed for Monday of this week, then came the charge by Tanner. Tanner asked that Carl Ruth erford, deputy circuit clerk, be placed on the stand and acne to Tay aeda In selec . erford’s testimony was taken. Rutherford that com missioner H. E. Crews vC. Bolen had “selected the present jurors jm. yd had been st —ourt terms since he been a de puty clerk.” Tanner asked the deputy clerk if the jury had selected fifty names, as that was the act of jurors, from the ore read ing the names of those selected, and if so, how could he account for the coincidence of twenty eight employees of the board of education being among those selected. Rutherford caused laughter the court room when he said: Well, Judge Tanner, I guess I will have to cite you to the law on part of that question—but I guess you know it anyway.” He then told the court that since school teachers were exempt by law from jury service while teaching, but not while on vacation, the teachers had been named and placed in the jury bal lot box for service in the July drawn from the box according term of court, and that they were to law. However, he said, the names had been selected singly and read as selected rather than selecting fifty names before read ing. It was on this “irregularity” that Tanner based his complaint and asked for the dismissal of the entire group of jurors. Prosecuting Attorney Frank E. Shannon asked the court to sus tain Tanners plea since there “was a posibility of irregularity in the method used to select the petit jurors. To offset any such complaint on the part of the de fendant, he requested that “these jurors be dismissed and the names now in the jury ballot box be destroyed, a new list compiled, and a new group of 50 jurors selected therefrom, and the case set for trial of Monday, August 2.” On dismissing the jury, Judge Easley told them: “Gentlemen, I am sorry we have to part. This charge on the part of the defendent is no reflection upon you, but in the manner in which you were selected. I have enjoyed having you with me, and can honestly say you are one of the most intelligent juries I have been privileged to serve since I have been on the bench. I am indeed very sorry to have to dis miss you.” Following the dismissal the court immediately named C.S. Smith and Charles Cameron as special jury commissioners to compile a new list of county citizens and select therefrom fifty petit jur ors according to the method pre scribed in the Code of West Vir ginia for service the remainder of the court term. This was done since the present commissioners are out of the county. The following jurors were selected and will report for duty Monday: W. 8S. Rev. D. L. Pennington, the pas tor, opened the program with the story of “Daniel in the Lion's Den.” The girls also enjoyed sev eral games. Mrs. Luther Barrett gave the closing prayer. During the social hour, Mrs. Kerry Kelly and Mrs. Luther Bar rett served refreshments to the following members: Frances Browning, Frances Marie Pais, Joyce Kelly, Joan Dal ton, Myrtelehe Wikes, Peggy Cooper, Gale and Peggy Weaver, Donna Jo Shields, elma Pen nington, and Rev. MEETS The Woman's Society of Chris tian Service of the local Methodist church met last Thursday even ing at the church with Mrs. H. E. Crews in charge of the pro gram was turned over to Mrs. George Cushing of Hunting ton who gave a demonstration of Stanley products. Those present were were Mrs. H. E.
