Verdict uf Voluntary Manslaughter Returned Thursday Morning.The jury in the case of Jim Hart, tried in Colquitt superior court for his life for the killing of J. M. and Horace Harnage, returned a vprdict of voluntary manslaughter when court convened Thursday mo rning. The case went to the jury late Wednesday afternoon.The trial of Jerry Hart, who was a party to the double killing, was taken up immediately by the court.The case of the State vs. Jim and Jerry Hart for the killing of J. M. and Horace Harnage, was taken up in Colquitt superior court Tuesday afternoon. The jury for the case was selected Tuesday and the taking of evidence began immediately. This was completed Wednesday at noon and counsel for both sides took up the arguments for the case in the afternoon.The Hart brothers killed J. M. Harnage and his son Horace in a dispute over the use of a road passing through a lane on the Harnage place. The Harts operated a saw mill and the Harnages alleged that their timber carts in passing through the lane frequently tore down their fences. The Harnages attempted to have the Harts’ teams stopped from using the lane by a recourse to the Justice Court, but lost out. It was when the Harnages attempted by force to stop the Harts’ teams from going through the lane that the tragedy resulted.The state is represented by Solicitor Wilkes and Cols. Covington and Summerlin; the defense by Col. Jim Humphreys, McKenzie Kline anc Shipp Kline.
