Indians have a right, under the law, to have the land upon which they were living on Feb. 10, 1890, allotted to them, and the law lixes the quantity each head of a family and minor child shall have. I must allot that quantity to them, and I have not in any case given any one more than he or siie was entitled to.”“What about grazing lands?” was asked.“The law says where the land is ‘mainly valuable for grazing purposes’ each Indian shall b»* entitled to double the quantity he would be otherwise;entitled to—or In other words he is entitled to 320 acres, as the head of a family, If the laHd is all good for agricultural purposes, but if mainly good for grazing he shall have 040 acres. The department rules that if the land can be raademoro valuable as grazing land than as agricultural it shall bn graded as grazing land, and the allotting agent aud Indian agent jointly must decide as to the general character of the lands allotted. In some instances I have decided the laud as good agricultural land, and made my allotment accordingly, but where most or a largo proportion of the land lies in the hills I think the whole tract allotted could uot fairly be called agricultural land.What about giving Scotty Phillips 1,900 ucres?*'That is not correct.
