If they win their case before the land ofBce the Indian department could appeal to the general land oflice, and thus run up additional bills of cost. The law by which the Sioux ceded their lands very plainly stated that an Indian would have to be living upon the land he desired to take when the president's uroclamatlou was issued. This being the case, it don’t stand to reason that they can now go to work and select lands anvwhere they 9ee lit to do for their children. Another point In allotting the lands is that they can be classed either as agricultural or grazing lands. If grazing lands, they are permitted to lake up just doublo the amount they would for agricultural purposes. It is understood that the agent is claiming most of the lands up Hud river as grazing lands. This Is altogether wrong. Mr. McKean, of course. Is sent here by the Indian department to virtually act as their attorney, hut In permitting them to take white settler's lands he is doing them an injury. If they are beuten in the contest—which they 9urely will be—they will not have a chance to take up lands in uuy other section.Special Agent McKean was met in the Locke lust evening by a Kkkk Prkhs reporter, and requested to make some statement that would show under what order of duty he was guided in the matter, that now bids fair to become a red-hot controversy. At first ho demurred, stating that lie was acting under Instructions and did not care to enter into a newspaper wran-glo. Finally, however, he volunteered the following:“I am endeavoring to follow my instructions and the law as construed by the secretary of the interior, and I have not intentionally or arbitrarily trampled upon any man’s rights.
