Mireal Lend Claimanta rans ana 5 Pedro Pino came in from Galisteo creek at 100‘clock today and delivered himself into the hands of the sheriff for the killing of Joseph Silva, a Por tuguese. He was accompanied by his grandfather, Don Nasario Gonzales, and his father, Herman Pino. From the former two the New Merxicas learns the fade as they understand them. At about 1 o'clock yesterday morn ing Pedro Pino, aged 22 years, was passing through the Janda of Nasatio Gonzales, tus grandfather, driving his sheep to water at the Gralisteo, Joseph Sive came forward from tia house, located some 1600 yards distant, and ordered ive off the land. Vino replied that the land belonged to his family but he refused to vacate. Silva then threatened to shoot him as he did not leave and in another in stant he pulled a revolver and fired, the bullet cruiking Pino in the right cheek and passing thhrough the mouth, coming out near the left corner of the lip. Silva was in the act of cocking his revolver to fire a second shot when Pino fired upon him. The bullet struck Silva in the head and pen etrated the brain, causing instant death. Pedro Iino managed to get to the river, where he washed his wound as heat he could and then went home and notified his family of the tragedy. Mr. Gonzales immediately sent word to the justice of the peace at Cerrillos, relating what had happened and asking that the body of Silva be sent for, and last night they drove in from Galisteo to deliver young Pine over to the county authorities. The case was being examined into this afternoon at the residence of Pro bate Judge Delgado, though very little beyond what is related above can be learned at this time for the reason that Pino's tongue is so badly swollen that he can not talk. The remains of Silva are at present at Cerrillos. Joseph Silva wan es native of Fortu gal, aged about 35 years, and had a large acqusintance throughout the county. Five years ago he ran a bar ber at Merton’s hotel, and also of late Gn interest in a shop at Cer rillos. It appears that he had gone to the land office and under the U.S. land laws had located a homestead on the Galisteoives, covering 160 acres of land. Part of this land so entered, however, was claimed by Mr.ionnalee as being on the La Gatera or La Vacagrant, as it is some times called. For some months the boundaries of these claimants have nt in ana and om bitter we are passed between the parties inter ested. The land is situated up the Galisteo about Sve miles east of Cer rillos. There Silva had built Lima dwelling, had cultivated the soil and had some covenly head of cattle. Iie had, for Word, complied in every respect with the government land lawa and evidently believed he had a sight to the land he had been allowed to enter as a homestead under the law. The La Galera great had never been confirmed by congress and is not shown on the official map at the land office, but it has been surveyed and Mr. Gon zales Claime it by right of outright pur chase from parties who owned it prior to the occupation of this country by the United States. It is claimed as having been granted to a community of Mexi can settlers in 1813 by the government of Mexico; from the hero and descen dante of these original grantees Mr. Gueseles bought it. Its dimensions are “1,600 varas up and down the Rio calister and from joma to joma.” According to Fredso Pino's state ment, he killed Silva clearly in self defense. It is another of the long list of tragedies that has come to New Mexico row the shameful neglect of congress in enacting some law for the settlement of land granta.
