Settlement of $9,000 for Mary Ellen Kane from Harry Buch man was reached this morning by attornees shortly before Mrs. Kane’s suit against Charles Atherton and Buchman was to be given a Circuit Court jury by Judge Bernard H. Davidson. Davidson had been scheduled to make his charge to the jury this morning, but the settle ment came earlier. Evidence in the case had been presented in Circuit Court for two days, ending with ar guments for both sides by the attornies Tuesday afternoon. Mrs. Kane of Escanaba had asked damages from Buchman as operator of the Dutch Mill. The plaintiff alleged that the Dutch Mill had served intoxi carts to Atherton after he al legedly was already under the influence of alcohol. The plaintiff alleged that Atherton, 40, of Mathias Town ship, Alger County, was drunk when his car rammed a car driven by Kenneth Kane early on the morning of Dec. 2, 1962. Kenneth Kane died as a result of injuries suffered in the crash and Mrs. Kane was hospitalized with injuries for over three months. The suit was one of the two filed by Mrs. Kane as a result of the crash. Action against Charles Atherton for his part has yet to be settled or tried. Mrs. Kane was taken to St. Francis Hospital by ambulance Tuesday after court recessed when she collapsed in the courtroom. She was reported in “fairly good” condition today.
