CHARLESTON, W. Va. CUPL) — Jury deliberations started today in the five-day-olds bias of a Baptist minister and in former coal miner wecused in the textbook protest related dynamiting of a Kanawha County school last Octobe. Court observers had ex pected testimony to spill over into the weekend,but the proceedings sur pisingly ended when both defendants—the Ray, Marvin Horan and Larry S. Stevens— refused to . the witness stand ey. S. District Judge K . Hall took nearly a bey in his instructions to the jury. He cautioned then not to consider the defen dants' decision not to testify. The law doesn't compel a defendant to take the stand.’ Hall said. ‘No presumption or inference can be raised by failure of a defendant to testify.’ Defense attorneys took less than an hour to rest their case, and no witnesses were called or Stevens behall. Witnesses included Alice Foran, the minister's wife, who said she and her were at home the night the school dynamiting and other protest activities, allegedly were discussed at Horan's anti-textbook Headquarters on Campbell’s Creek. Prosecution testimony had placed the Horans at the bnfilding on Oct. 21, the night before a dynamite bomb was set off inside to gid way elementary ing arguments by attorney centered on the prosecution testimony of Delbert Rose, who earlier pleaded ‘guilty to a role in the seriool bom bing. “Delbert Rose has du mitted his part in the con spiracy, attorney Michael Aiken told the jurors, “He hasn't been sentenced. He realizes how important it is now to cooperate with the government.
