CHAPTER fc AN ACT Prescribing the terras aud condi-, liana ou which the State will relinquish aud convey to the l*s Moines Railroad Company certain right anl privileges in respect to the/esnnption of Lands hcroios fore granted to said Company. t\ u;:hkas, Ry an act of Congress approved August 8, 1645, there was granted to the then Territory of Iowa certain laoda to aid in the improvement of the Des Moines River, in said Territory, which grant the State of lotra, by j':ut Resolution to the General Assembly, approved January 0, 1S4T, accepted for the purposes thereiu specified ; and, t' iik■ cas, The General Assembly of this State, by an act appr.ved March 22, 1838, which granted such portion of said lands cs had not been previously disposed of, to the Keokuk, Fort Dos Moines Minnesota Railroad Compmy, to aid in the construction of a 1 railroad from the City of Keokuk up and !• long the Valley of the Dos Moines River by the way of the City of Des Moines to the northern line of the State, in the direction ot the southern bend oft lie Minnesota and St. 1‘eiers River, and providing that said grant should become operativd when the conscut of Congress to the diversion of said lands should be obtained, or the title thereto vested in the State ; and also imposing upon said company in case of its acceptance of .aid grant certain conditions aud restrictions, auioug which it was provided that said company would complete seventy-five miles of said toad within three years, thirty-three tuiles each year thereafter for five years and the whole liue oa or beforo the first day of December 1808; and,1 ucmcAS, Such consent of Congross to the diversion was given by an act approved July 12, 1802, aud said company afterwards accepted said grant; and,Wuejikas, Said Keokal, Fort Des Moines i Minnesota Railroad Company is now known as and called the Des Moines Valley Railroad Company; and,WuBRKAt, Said Railroad, [company] is in default in respect to the time of construction of said road, and In the performance of other conditions of said grant, whereby the State has a right to resume the whole or part ol said lands; therefore,StcTiox 1. £e it enacted by the General Aua*hly of the Stale qf That the re*,served rights and ItRercsts of tho State in I* npcct to the resumption and disposal of said lands are hereby relinquished to and conferred upon said Dos Moines Valley Railroad Company in the manner, and upon the performance of the conditions precedeut by said Company, as hereinafter set forth, and noi otherwise, vii: iVw*—That it shall be the duty of the Register of the State Land Office as soon as prac tic able, and before the first day of July 1808 to aet apart and reserve from the remaintn| river lands within the grant and lying it place next north of township No. Ninety, ant upon which there are no eettlers claim!U) homestead rights, and exclusive' also of tb ten sections set apart and seld to S11 Taft, on*
