Tonii., April G.— When Judge Sanford took his seat on the bench of *hc Federal court shortly brlore 1 o’clock this afternoon he delivered his opinion In the matter of the motion for peremptory instructions In the case of the United States government vs. 4 0 barrels and 20 kegs of coca-coln. which has been on trial here for the past three weeks.This motion was argued yesterday, consisting of a.000 words. In his opinion Judge Sanford sustained the motion on certain points to the effect that caHlne Is not an added nor deleterious ingredient, but overruled the motion on points relating to the misbranding feature heading that these were questions for the jury to jas8 upon.Thereupon counsel for government moved to dismiss the cose without prejudice on the points relating to misbranding. The court then directed the jury to return a verdict for the defense, which was accordingly done. Government counsel entered a motion of appeal to the United States Circuit Court of Appeals at Cincinnati.
