—The prosecution in tho case of William and James Hunter, arrested on a warrant sworn out by H. M. Vaile, on a Gharge of tearing down a fence belonging to him (Vaile), failing to bring sufficient proof that the defendants had no right to tear down said fence, and the preponderance of evidence showing that the fence was on the land of Mr. N B. Stoue, ot which the defendants were tenants, ’Squire Bean dismissed the defendants and rendered judgment for the costs o( the suit against Mr. Vaile*
