Kitehin weakened his cane by some of the reasons he gave for commuting the santence of Raster Shemwell.Mr. Shemwell's second train holdup might have entitled him to n full pardon for the original offense if he had displayed his guns or shot the conductor.The physicians who examined Shem-well say they found that he had a “weak heart” or sorne other trouble. The other trouble” probably was « bad heart.Powell’s case was not removed by request of the defense, and the timely sickness of loading counsel did not seem to affect the status of the trial, but it will be held in another county all the same*.The early date for holding the Press Convention knocks interest out of nt least one member. The date originally fixed, .June 22nd-2-tth, was to early in the season we thought but that was better than having it sooner still.The case of E. E. Powell was removed because defendant could not get justice In the county where the crime was committed!?) Rut justice is not what Powell wants, and it is not what his lawyers will let him have if they can prevent it.The constituted authorities »« quick to call out the militia i summon posses to protect a bn criminal who deserves hanging, b law and order and the interests society are too often forgotten in t trial or after a conviction has be had.SrimosK Raster Shemwell’s physical condition is such that a live mouths jail sentence would lie detrimental to his health whose fault was it that he found himself in the position of facing either imprisonment or a Hue? Liability to escape punishment on such flimsy pretext as jeopardizing life or health in enforcing the law is a bad precedent to establish.A man must be a sorry sort of citizen who admits that he is so prejudiced in his feelings that he could not sit in a jury box and after hearing nil the evidence in the case reader a fair and impartial verdict based on the law and the evidence. Fact is we believe some of those men lied t o keep from being drawn on the Powell jury in Halifax. We still maintain that Governor Kitehin, with the facts before him, acted humanely in commuting Shemwell’s sentence, but the man has proven himself incapable of appreciating a humane motive anil has vindicated the estimate set by him of his vindictive enemy. If there is any law to reach him. and we think there is, Shemwel! should be made to suffer the extreme penalty. Roth the railroads and the traveling public are entitled to protection from bullies of the Shemwell stripe.We do not exactly understand what it means but the following editorial pnragraph which appeared in the Charlotte Observer of Sat urday, would seem to indicate that the story printed elsewhere about Raxter Shemwell’s second train lioldup last week is not altogther true Still we cannot believe that the Greensboro News and the Raleigh News and Observer. the Salisbury Post and other papers could all have been imposed upon. There must be some truth in the alleged occurrence or it would uot lmve been printed. Rut us to the Observer's observation:.Mr. Raxter Shemwell’s varied career. will, we hope, be that of a good citizen henceforward, but afrall events no one has the right to circulate false and injurious stories about him. The man who imposed upon a newspaper the story that he forced a conductor of a through train to stop at Lexington Thursday night deserves harsh initiation into the Ananias Club or its equivalent.Friends of Gen. R. S. Roygter, of Granville, are pushing him* for the Congressional nomination and will stand by him so they say, until the shouting is all over. Gen.
