May 15.—(SP.)— The Jury of view” that has had In hand for several months the choosing of a road site through and around Limpla canyon made Its report Tuesday to the commissioners court and designated the road through Llmpia canyon. The commissioners accepted the report and ordered the adoption of the site chosen. However, there are various conditions and aspects of the situation and the matter was far from settled. Following are the highlights of the subject:The jury, consisting of J. W. Espy, Jimmie Duncan, Roy Reid, and W. W. Negley decided upon the site as surveyed by Engineer A. J. Adcock and allowed damages for the land It will take in at the rate of $7.50 an acre, and no further damages. This land belongs to George and Harry Grierson, B. B. McCutcheon and J. W. Mc-Cutcheon.After considerable discussion, the commissioners by majority vote accepted the report en toto. including the amount of the land damage.H. O. Metcalf. Marfa lawyer, was present as attorney for B. B. and J. \V. McCutcheon. Maurey Kemp. El Paso lawyer, was present as the attorney for the jury of view. B. B. McCutcheon was present.McCutcheon1 brothers, through their attorney, called attention to further damage claims that they had filed. These consisted of higher claims for the value of the land, claims for fencing the road on both sides, claims for water damage and damage relative to a proposed dam site, permission for which the Mc-Cutcheons have secured from the state.When the commissioners formally refused to allow these claims. Mr. Metcalf, for the McCutcheons, immediately gave verbal notice of appeal to the district court.However, there are further conditions.Monday and Tuesday Glbb Gilchrist, state highway engineer, and Judge Ely, member of the state highway commission, were here.
