This suit on the second trial went against the Defiance Bank .and that fact added to she Bank’s embarrassment.About the time these certificates were issued, one of the branch companies of the Crcclmans drew a check upon the Defiance City bank in favor of a Tennessee Bank. When the check was presented, its payment was refused for want of funds. Mr. Daoust. Cashier of the Defiance City Bank thereupon wired the Tennessee Bank to the efTect that if the latter would return the check referred to. it would be paid. It appears that the money to take care of the check in question did not reach Defiance and upon its return for payment, payment was again refused. Thereupon the Tennessee Bank brought an action in the U. S. Court to recover the amount of the check and J.ft* r protracted litigation obtained judgment for its amount which was nearly $5,000.The failure of the Creelmana coupled with the obligation imposed up on the local institution of paying these certificates of deposit and the check mentioned, all of which was without any consideration to the Defiance Bank, still added more to its embarrassment. Notwithstanding all these embarrassments the local institution has made a heroic light not only to maintain its institution but to place Itself upon a sound footing. The Bank had been designated as City Depositary and as Depository of several outside townships. The U. S.
