By the contracts hereto annexed, marked respectively exhibits “A” “B ’,signed and executed by said Commissioners, the foregoing statement of facta is fully verified, and, amocg other things, it will be seen, by reference to said contract, mark ed exhibit '*B” that said Commissoners use the following plain and unmistakablelanguage: “ V* e, the Commission ere, for thepurpose of carrying out in good fatth the proposition above set forth and accepted by the city of Alton, do hereby agree to and with the said city of Alton, THAT YVE WILL REMOVE THE PENITENTIARY FROM SAID CITY OF ALTON, OR CAUSE THE SAME TO BE BEMOVD, etc., and for the faithful performance of this agreement, we hereby bind ourselves and our successors in office,” etc. And your memorialists, for greater certainty, pray that careful and full reference maybe made to said contracts and the severalexhibits hereto attached.And your memorialists, for the purpose of showing that the universal sentiment of Alton is opposed to a return of conviot labor to said city, respectfully direct attention to the resolution adopted by the Common Council of said city, on the 14th day of February, 1877, by a vote of ten-againet one, and also to the petition of eit-zens. which resolution and petition are hereto attached, marked exhibits “C” and *‘D.” And your memorialists respectfully say that any claim that public sentiment in Alton favors the location of a branch Penitentiary kin said city, is altogether without foundation in fact.Although your memorialists are counseled that said contracts are binding upon the contracting parties and that the servants of the State oan be restrained by law from doing any act contravening the same; yet, your memorialists are deeply impressed with the conviction that the State will in the future, as in the past, and after being assured of the facts in the premises, continue to adhere in good faith to its contract, and will not attempt to foist an institution upon the people of Alton after said city bad paid the State to remove the same from that city.Most respectfully submitted.J.
