G.tSir:—In accordance with “circular,” dated “Jan. 7,1803,” issued from Headquarters of the Second Division, requiring a minute and de tailed statement from Regimental commanders of the operations of their respective regiments, including casualties, I have the honor tt* report:That on Friday, Dec. 25lh, 18G2, this regiment, under command of Col. J. B. Dodge, left catnp near Nashville, Tenn., marched half a milo south of NolGiiville, where wc encamped for the night. Next morning, Dec. 27, the*Sec* ond Brigade being in advance, wc left camp at sunriso and moved in the samo direction cu the turnpike as the day previous. After ad-vancing ouo and a half miles we were ordered into line ol battle to support Capf. Edgarton’s Battery, in which mauncr we moved throe or four miles and until dark, when we were order, ed out op outpost picket. On the next day, Dec. 28, after being relieved from picket duty, we remained in camp without any further active service. Ou Dec. 28, we moved back to. wards Nashville two mi'eu, took a cross road leading towards Murfrecbovo, and after matching six miles encamped for the night. On Dec. 30, wo moved towards Murfreesboro threemiles, when wo ware ordered oft to tho right, and after throwing forward two companies each, from the right and left flanks as skirmishers, moved forward one mile in lino of battle and bivouacked for the night in a cedar thicket.— On tho morning of Dec. 31, the enemy advaneicd upon us in force about daylight, driving in our pickets, making it necessary for us 1u fall back or move out by the flank to the right. Tho latter movement was made with the lors of one slightly and one mortally wounded, except upon tho picket lino, which being doubled during the night by two additional companies to ensure vigilauce and safety, suffered severely upon being driven iu. The movement by the flank was a fortunate one for us, for had wo remained any longer in that position, we should have been either cut to pieces or taken prisoners by the enemy, who were in great force in our front. After moving to tho right and rear about half a mile wo formed a line of battle in a meadow behind u fence, whcro wo were joined by the remnants of the four companies who were on picket the night before. After sending out two companies as skirmishers acrqss a field to a fence directly in our front, we moved up to the samo place and then the action commenced in earnest. Gen. Kirk having been wounded early in the morning and Col. J. B. Dodge of this regiment having taken command of the Second Brigade, the command of this regiment fell upon the undersigned. After tho regiment upon our left and wo bad sustained tho enemy’s fire tor some time, the 79th Illinois advanced briskly to our immediate right and supported us gallantly, hut being outflanked by a superior force of the enemy and exposed to a lioavy cross-fire, they fell back and wo were obliged to do tho same, having no support whatever, and having suffered heavy loss as hereinafter 6tatcd. In retiring the men became much scattered, but were mostly collected again and then ordered to the front on the Murfreesboro turnpike, three mi cs from town.Jan. 1,1863.—Aftor entering breastworks wo remained behind them without any further activo service except skirmishing on picket lines.Jan. 2.—The same routine of duty as tiie day previous except, that in the evening, tiic le't wing was sent out, with parts of other regiments of this Brigade, aB skirmishers, to feci the position of the enemy, but after receiving a severe fire ar.d supposing tho enemy to bo in98,tolieLegRickc-land P. missio Fain Ilumpl Marioi: electee}2d LEditorDeaiSwagedtory pt A fij earncs paralle been e troops conflici on theThowon u] Co!. Its im1 porluiieo is increased by tho fact that the decision of the point will affect four or five other members*scats. Mr. Dills claims that Mr. Dickinson vacated hia ofiieo as Senator, by accepting the appointment of enrolling and drafting commissioner of the militia, last August.Tt esc questions arise : In tho position an office within the mcauing of the constitution ? and, second, If it is an office, and accepted after being sworn inasScnator.but does not now hold tluit office, is he entitled to a seat in tho Senate?
