V: XIT. And be it further enacted* That no nob-commissioned officer, musician or private, on the first or seeoud division for duty, shall absent him*1 If from hb regiment after the commandant thereof has received an order requiring a detail to be made, and of which tike said non-commissioned officermusician or private shall have been, in any way or by any means, informed, until sueh detail shall have been made. And every non-commissioned officer, musician or private, on the first or second divi*on for duty, who shall absent himself as aforesaid, and who shall be subsequently detailed to march iQSUott requisition, shall he considered and treated as a deserter,XV. The adjutant-general shall be, and he is hereby authorised and required, whenever a requisition is made for troops, to direct uu officer to muster ami inspect the men detailed from rach regiment lo take the field, who together with the surgeon of the regiment, shall be held responsible for sending into service any person incapable of performing military duty ; And the said adjutant general shall also direct a court of enquiry to sit, who shall decide upon appeals from the decision of the inspecting officer and surgeon; and hear and decide upon excuse* made by pfersona detailed for service.XVI. And be it further enacted, That the bounds of a-company of mUfti* shall not be hereafter divided, unless the number of iniliija men within #\p same shall exceed one hundred and eight, officers included.XVII. And be it further enacted* That every inspector of a brigfrfft shall employ a competent drum aud fife major to attend the trkiuing ot lbs officers throughout the brigade, who shall be allowed dollars perday for their services, to be paid in tlie sume manner as the compensation a|| owed the brigade inspector: And the Rdrununers and fit'ers of each regiment shall be summoned by the officer having immediate oouunaod over iUe«a (q attend the training of the officers to be taught the difterenv bests and urn obef by the drum and five major aforesaid, whose duty it shall be to jnstruct ihem under the direction of the brigade inspector. Any drummer qp lifer failing tha to attend the training of the officers, as aforesaid, shall be subject* to a fine, not less than nor more than ^ dollars, to bo imposed andcollected in the same manner as the fines on commissioned officers lor failingto attend »wob training.XVIII. And bz it further emitted* That the fines imposed by law upon a nnn-cointuissioned officer, mu si rim or private, for failing to appear at the place of rendezvous when ordered, or failing to march when ordered, or to furnish a substitute, whall be certified by the president oi the court befor® whom the same shall be assessed to the sheriff oi the county in which the delinquent shall reside, and also she auditor of potilic accounts, noting in the certificate to the auditor the residence of the delinquent. The saidvheriff sha.f proceed forthwith, upon such certificate, to levy the said fine with c «stsby distress and sale of the goods and chattels of the delinquent; and shall pay aft such fi3* by him levied into the public treasury at the same time that tho public revenue is payable; shall be entitled to the same commission thereon as Tor the collect ion of tbo said revenue, and liable to be proceeded again»t for a failure to pay lue same in like maimer as for a failure lo pay the public revenue. And, m the dew commissions to be i-sued as aforesaid, the dctte of the former commission shall he inserted, and the relative rack of said officers shall be governed by ike dales of their former commissions.XX. And whereas there are loo many light troops in this commonwealth, be it further enactvd, that in all cases where thv re are more than one company to a battalion, it shall be the duty of the iield officers of the regiment or a majority of them to decide which shall be reduced to the general mass of the militia, and the same shall by their order be reduced.
