NOT EXEMPT FROM ARMYSo Rules an English Court in n Case Affecting a Resident of the Copper Country.Possession of “first papers by former subjects of England who are now located in the United States, does not bar the holder from military service, if he should return to Great Britain, according to u ruling in a court in Cornwall, Eng., affecting a former resident of the Michigan copper country. The court in its decision held that the defendant is liable to military service, and is guilty of neglect in failing to respond to the call to the colors and subject to punishment.The defendant, Albert Menadue of j Perranporth, returned to England inj]■ tApril, 1914, for a short vacation, but his parents prevailed upon him to remain with them. In May of last year the ports were closed to men of military age and attempts to leave Britain failed. Menadue then found temporary employment in a munition plant, but he lost his position on account of his protest that he was an American citizen and no longer a subject of King George.He was summoned into the court of Truro, Cornwall, for failing to respond to the colors, and his defense was that he was an American citizen. He produced his declaration papers, claiming that his interests and property were in America, where he had resided for upwards of eleven years, and that therefore he was no longer subject to the laws of his native country. This was considered insufficient reason under the Derby military law, and in handing down a deei-the first cuss cf its kind that had come to light, and therefore had not precedent to guide its decision. The outcome was, however, that Menadue still was a British subject, because his papers constituted merely a declaration of intention and therefore not binding.Try a News Record ad. for results
