During arraignment proceedings Thursday morning in Clinton Cir cuit Court, Robert S. Brummett, 23, Lafayette, waived formal arraign ment and entered pleas of not guilty to both murder and battery charges. He also requested a jury trial. Brummett’s attorney asked leave to file the motion to dismiss the charges within a week. Judge Sam Conkright granted the request and set a hearing on the motion for June 27 at 10:30 a.m. If the motion to dismiss is denied the trial is expected to be set for sometime in September or soon after. Brummett is currently put on a property bond filed by his parents, Wilson and June Brummett, with whom he resides in Lafayette. Brummett is charged in the January death of Delphi businessman Jerry Hurley, whose body was found January 23 at the bottom of a cliff in a limestone quarry in West Delphi.
