Tuthill. in citing Carlton Prouty, the Winnetka banker and real estate man, to appear before him on March 13 to answer a charge of contempt of court, has taken the first step in an effort to check marriages in other states in violation of the laws of this state. The interest of jurists, lawyers and the public generally in that effort was manifest yesterday, because thus far no precedent has been established for the punishment of violators of the Illinois statute which prohibits persons who are divorced in this state from again marrying within a year of the decree.Prouty married Miss Mary Busscher sit Laporte. Ind.. on October 29, 1912, four days after a decree was granted to his I g; first wife, Mrs. Carrie B. Prouty, by Judge' C Tuthill. The present contempt proceedings are the result of an investigation by the Chicago Bar Association. re“The reason Judge Tuthill cited Prouty | aJ to answer contempt charges I presume was because there appeared to him no other ground on which Prouty could be held answerable,” said John T. Richards, president of the Bar Association.“The Illinois statute provides that such a marriage is illegal, and also that a violator of the statute can be punished by one to three years’ imprisonment. The section referring to imprisonment, however, has been held invalid by the Supreme Court, though I understand that the statute’s provision that such marriages are illegal still holds. Therefore, it seems to me that Prouty could be punished for his act in living illegally with his second wife in this state.”“This citation for contempt is a thunderbolt from a clear sky,” said Carlton Prouty last night. “I have made a will, providing for my second wife in the event of my death. I have to go to jail on March 13 my wife will take up my duties as collector of the Town of New Trier.I have no fear of the result, however.In the event that a child is born within the year following my divorce it will be born in Indiana in order to insure its legitimacy.”tcyoitapofat
