IS YOLK NAMWRITTEN THERlMANY MARRIAGE RECORDS ARESADLY INCOMPLETE.Wedding Ceremonies in Many Cases Forgotten by the Minister or Magistrate Very Soon-of the iAn examination of the marriage reqords in the county clerk’s office reveals a startling condition of affairs. Many couples living together as man and wife are not duly married, or at least there is no legal«*ecord of their marriage at the court house. The records show that many marriage licenses have been issued by the clerks and deputy clerks and the officiating clergyman, minister, priest, judge or justice as the case might be, failed to make a return. There are a number of marriage licenses issued in cases where the couples fail to become wedded, but t ie majority of the cases where no marriage is' recorded is due to the carelessness or negligence of the officiating gentleman. The failure to record the marriage does not invalidate the marriage, but there is no legal marriage as the parties might discover to their advantage in many cases of real estate transfers and court proceedings.The officiating minister or magistrate failing xo make a return is also guilty of a violation of the laws of Indiana and is subject to a fine. The law from Burns’ statute is very clear and is giver, herewith.Sec. 7296 h. Marriage Certificate.Every person who shall solemnize any marriage by virtue of the provisions of this act shall, within three months thereafter, file a certificate thereof in the clerk’s office of the county in w hich such marriage was solemnized; which certificate shall, by such clerk, be recorded, together with such l.cense; and such record, or a copy thereof, shall be presumptive evidence of the facts therein stated.Sec. 2270. Failing to Return Marriage.Whoever, having solemnized a marriage. fails to return a certificate thereof, with the license therefor, within the time prescribed by law, shall be fined not more than one hundred dollars nor less than five dollars.An examination of the records from January 1, 1884 to October 23, 1904, a period of nearly ten years, shows licenses issued on which returns were never made, as follows:Schuyler C.
