NW1/4 23 12 S. 25 E. up to 110.3The purpose of this application is to permanently transfer 278.1 acres of water rights, 834.3 acre-feet per annum of artesian groundwater rights, under OSE File No. RA-2404, to OSE File Nos. FIA-376-A and FtA-960. The transfer of water may result in a stack of water at the move-to place of use. The stack of water will be used to repay the over-diversion of water for RA-376-A and RA-960. The application is being filed in conjunction with a Proof of Beneficial Use Survey for 3V Dairy for water right File No. RA-2404.The 834.3 acre-feet per annum plus carriage loss are being moved from wells RA-2404-S and RA-2404-POD3 and being stacked on the existing water rights land under FtA-960 and RA-376-A.The move-from well and place of use are located approximately 3.5 miles north-northwest of the Hwy 70 and the intersection of West Pine Lodge Rd in Roswell, NM and the move-to well RA-960 and place of use are located approximately .24 miles east of intersection of Old Dexter Hwy and Vista Largo Rd in Dexter, NM as well as move-to wells RA-376-A and RA-376-A-S and place of use located approximately .59 miles east of intersection of Old Dexter Hwy and E Darby Rd in Dexter, NM all in Chaves County, NM.To view the application and supporting documentation contact the State Engineer District Office to arrange a date and time for an appointment located District II Office, 1900 West Second Street, Roswell, NM 88201.Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 1900 West Second Street, Roswell, New Mexico 88201, on or before March 10, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 575-623-8559. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
