He alleges in his suit that he transferred the property and cash to his wife in 1807. when he was ill and thought he was about to die, with the understanding that sheshould make restitution in the event of his recovery.By 1901! he had fully recovered, and. ac cording to his sworn statement, asked her to comply with her promise. Not-only did she fail to return the residence and money, but ordered him out of the house.
