Sunday, September 21,1969Club Owners Ask Contract Be RescindedPERU—Eugene and Wanda Gipson, new owners of the Peru Jockey Club, have filed a complaint in Miami Circuit Court against the former owners, James, Nancy, and Joseph Donat, claiming they have been defrauded.The Gipsons ask that the_contract to purchase the business which was negotiated May 1, 1969, be rescinded.They claim that when the contract was negotiated the Donats were to transfer the license, but j that this has not been done and they cannot operate hte business without it.They further claim that contrary to terms of the contract, they were forced to pay $1,468 on the Donats’ business indebtedness, although the Donats assured them that there were no outstanding debts.According to the complaint, the Gipsons made a $10,000 down payment, $2,980.75 monthly under terms of the contract; $1,134 for the license renewal; and $400 for insurance, for a total of $15,983.16.They claim they have been defrauded by the Donats’ misrepresentation.
