ORDINANCE NO. 793AN ORDINANCE TO BE ENTITLED “AN ORDINANCE TO PROVIDE FOR ADDITIONAL REGULATIONS FOR THE RETAIL SALE OF BEER AND LIGHT WINES, PROVIDING PENALTIES FOR VIOLATION OF SAID REGULATIONS, AND FOP OTHER PURPOSES. WHEREAS, Ordinance No. 700 docs not provide proper supervision for the retail sale of beer and light vines, and for the revocation of licenses for selling the same in the City of Fayetteville, andWHEREAS. It is necessary for additional restrictions to he placed on the sale of the same and to provide for revocation of licenses, THEREFORE. Be it ordained by ithc City Council of the City of i Fayetteville;Section 1. H shall be unlnw-ifu! for any person, firm, corporation. or association to make false answers in any application 10 . questions touching his qualifications for a permit to sell beer and light wines in the City of Fayetteville.Section 2. Tl shall be unlawful lo sell beer or light wines in any . residence, or in any house or building used in part as a itssl-i deuce, or built onto, or is a part of any residence: provided, how-, ever, that this section shall not apply to places of business whore apnrlments lt;ne located over the : some.Section 3. It shall be unlawful to sell or serve beer or light I wines, or allow the same to lx i (.unsullied, in any dance hall or place where dancing is carried on; and it shall be unlawful for danc-: ing to be allowed in any place . where beer or light wines are being sold, diopeinrod or served: and it shall he- unlawful tu sell beer or i light winrs In any place nr building where there Is a direct en-; trance allowing ingress or egress i lu any dance hall or place where dancing is allowed. Provided,however, thru no part of this section shall apply to private homes being used exclusively as such.Section 4. It shall he unlawful to sell beer or light wines within 200 feet of any church or any public or parochial school m the residential section of the City of Fayetteville. The residential section of the City of Fayetteville shall be any part of said City that is outside of the fire zone as is now or may hereafter be fixed by the City Council, and the business section of the City of Fayetteville is that part of said City within the fire zone.Section 5. It shall be unlawful to sell heer or light wines in the residential section of the City of Fayetteville between the hours of 12:00 o’clock midnight and 7:00 o'clock in the morning, or to serve either or allow either to be consumed in a public place between those hours.Section G. It shall be unlawful to sell beer or light wines to any person who is Intoxicated at the time the sale is made.,Section 7. It shall he unlawful for any person, firm, corporation, or association engaged in the retail sale Of beer or light wines in the City of Fayetteville to allow any intoxicated person or persons to loiter in' his place of business.Section fi. If any person, firm, corporation or association engaged in the sale of heer or licht wines in the City of Fayetteville shall allow any person or persons of dissolute character to loiter in and around his place of business, or shall permit profane language therein, or loud or unnecessary noises, or condurt his place of business in any other way that is detrimental to the good morals of the community, or in such manner as to constitute n nuisance, nr if the City Council shall find that any retail dealer in beer or ligld wines has made false answers to Questions touching his qualifications to sell the game, then theCity Council shall revoke the license of sueli person, firm, corporation, or association to sell beer or light wines in the City of Fayetteville.Section 9. Nothing in this Ordinance shall be construed as repealing any part of Ordinance No. 760, but this Ordinance is .and shall be supplemental -thereto.Section 10. Any person, firm, corporation, or association violating section 3, 2, 3, 4, 5, 0, or 7 of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be fined any sum of not more than Five Hundred Dollars ($500.00), and each day's violation of said Ordinance shall constitute a separate offense, and in addition to such fine, it. shall be the duty of the Court to revoke the license of anyone so convicted.Section II. It being ascertained and found by the Fayetteville City Council that the unregulated sale of beer and light wines in the City of Fayetteville, constitutes a menace to the public peace, health, and safely of the citizens of Fayetteville and requires the immediate passage of no ordinance to regulate and control sale of beer and light wines, nn emergency is hereby declared to exist, and this Ordinance shall take and be in force from and after Its passage.Approved: A. Mrs. Johnson said she signed Jerome F. Mnndn’s $1,5110 bond and he once “jumped’' it. On the way here, she related, the car lights went out and .Mando offered to repair them if she would unlock the handcuffs. Declining, she used a flashlight on the 17-mile drive to a garage.
