JUBY RENDERED VERDICTIN NIXON CASE.In the damage suit case styled Mrs. Cora Malone et. al. vs. tbe estate of S. M. Nixon wbicb was on trial here al' last week, the jury, at 6 o’clock Saturday evening returned a verdict lor tbe sum of $5000.00 divided as follows: Mrs. Cora Malone $1250.00, Robert Malone $1250.00, Corlnne Malone $1250 00 and Bessie Malone $1250.00, tbe three last namedhildrea of Mrs. Maloue.The cause of this suit is yet ffesb in the minds of Post read* ers. On May 7, 1904, S. M. Nixon met R. W. Malone on tbe streets of Luting and shot him to death. Suit was immediate*, ly instituted for damages to tbeextent of $50000.00 Jagainst Nixon. In April ibis year Nixon died and tbe s.lit was transferred from against him to bis estate. It came up last week and consumed the entire week. There was a large number of witnesses to be examined«and not until Friday morning did they begin to argue tbe case Tbe jury took the case in bands Friday evening and returned a verdict as above Saturday even» in g.Messrs Greenwood, of Rulingand Robertson, of Austin represented the plaintiffs and the Nixon estate was represented by Messrs A. B. Storey and E. B. Coopwood, of this* city and Sam H. Hopkins of San Antonio The foreman of the jury was R. B. Dawson, o' this city.Mrs. Barbee, of Lnlmg, tbe mother of Mr. Malone, who had joined in tbe suit for damages was not given anything.The case attracted considerable attention and interest and the District court room was well tilled wtf h spectators ev;ry day.
