Cooper, who has said that gambling at race tracks must and will stop. ’But over at Fairfield sixty men employed by John Lemon, Dayton conn actor, are rushing to completion a new nog racing plant that is being built by Fairfield Amusement Park, Ltd., made up of a group o! sportsmen who sa the track will open with a full program of dog race.. Tueir investment includes the forty-acre track on which the plant is located and which was purchased from the Miami Conservancy District, although located within the Fairfield village limits.The promoters expect to operate the track under authority gained in an ordinance passed by me village council, wkica includes a $200 a day license clause, but state officials say that the state law forbids race gambling and that the state law would supercede the village ordinance Sportsmen agree that the track cannot be operated profitably unless some form of gambling is permitted.Johnson ha* indicated that the promoters expect no trouble from the authorities because the system ot betting to b* * mplojed j.- not in violation of the state Jaw and has been held legal in several other states where tried Prosecutor J. Carl Marshall says that any form of gambling permitted will be considered In violation of the state law, but that no action can be taken until the track is opened and there is evidence that a \iolatioo of the gambling law actually exists. There is no law against nog racing in Ohio and the track cannot be attacked unless betting is permitted.In the meantime the promoters are apparently unperturbed by the action against race track gambling taken by the governor, civic and reform group* and by merchants, who believe operation of the track would create an economic loss to the community.
