McKiusey and George Hollingsworth have brought suit for injunction against William A. Tucker and Lucy Tucker. McKinsey is the owner of 40:50 acres in Marion township and Hollowingsworth 09 acres in the same township. The defendants are also owners of land in that township. The lands of McKinsey aud defendants join and the land of Hollingsworth is separated from the others by srpublic highway. Through the plaintiff’s land there is constructed a tile drain with a ca/-pacity adequate only to drain their lands. It is averred that the line upon which the defendants are digging and constructing the ditch is not the natural course which the water from the defendants’ land would flow, but that the defendants are intentionally diverting the water from its natural course upon the lauds of the plaintiffs.
