Judge Houghton Says So--SmothersCreek Ditch Case.Last September the board of commissioners of Daviess county refused to allow the estimates and assessments made by the surveyor on the proposedSmothers’ creek ditch improvements on the ground that the law was not constitutional.The attorneys for the petitioners appealed to the circuit court. Judge Houghton, after hearing the argument, took the matter under advisement atthe time and Tuesday handed down a decision to the effect that the law is constitutional, thus reversing'the decision of the commissioners’ court.Judge Houghton’s decision puts the matter on its feet again just as it was before the commissioners threw the case out of court. The case is remanded, in other words to the commissioners’ court. Win. Bowman, Jno. Eads and Gallatin England have the costs to pay.
