The Humphreys’ Case.—Elsewhere we publish the decision of the Supreme Court, on the application of Samuel McCormick, et aL, for the setting aside of proceedings in the Sullivan county court, in the suiti j _against them by Andrew Humphreys, for damages for his arrest as a member of the Order of the Sons of Liberty, and the transfer of the case to the United States Court under the act of Congress, approved March 3, 1863. The decision is somewhat lengthy and will be found interesting and able. The array of authorities brought forward to sustain the constitutionality of the fourth section of the act named, under which the transfer was claimed, are unanswerable.The decision was made by Chief Justice Ear.
