M. Pilcher. Is to set his fence hack at once, give a private way through a certain tract of cleared land, running by an Oak tree. In line with a certain pine tree, that the fence .is now fastened to. He agrees to let ning|that stay open, until the sawmill Is removed, and a public road is built. It being understood that the Commissioners are to build the public road as contemplated by them after the saw, mill is removed, sAid private way as granted by J. M. Pilcher not to be subject to prescriptive rights under the law, and to remain open only until the certain events as stated above shall occur. This agreement Is founded upon the mutual promises of the undersigned parties, and relate to a certain road and private way, said road to run through lot 114 and the i'ed- I private way through lot 115 in the 17th all I district of Thomas county.
