This information is being provided the public through the cooferation of the Missouri Press Association. •.....»Missouri’s employers who are liable under Ihe state's. unemployment compensation law not only carry the responsibility for financing tbe entire employment security program, but they also are called upon to help the state police the payment of benefits to unemployed workers.Cooperating employers, usually those with eight or mare workers,oaciut the rlitHcrinn in Qtimnintf ..iki!assist the division in stopping the payment* oi questionable claims for unemployment insurance, and industry through quarterly wage reports aid in the detection and discovery of fraud practices perpetrated by “chis-elers,” 1 * ’i ■ , ;aV, ..This employer cooperation also extends t6 state employment serviceswhen they place their orders for workers withsthe job-finding agency.Payments to workers do not begin until the division has made a check on the claimant’s eligibility for unemployment insurance. This checkup tells the division where the worker has earned the wage credits which rrtight make him eligible for benefits.and fthere still Is the additional privilege of appealing to the state courts.When appeals matters are reviewed by the courts, the findings of fact of the commission, if supported by competent and substantial evidence, will not be disturbed by the court. It wifi confine its review to questions of law involved in the osee. : '■**.. ■ ■ . t '•It, therefore, behooves the employer or claimant to carefully present all relevant facts for consideration by the division’s referee, because if the evidence is not submitted in the original hearing, it cannot later be introduced before a court.“Employment” is a complex term which, is defined in detail in the Unemployment Compensation Law. In general any service performed by any worker for wages lit employment.Employer Gets Claims NoticeBenefits are withheld until every employer, whose account might be charged with unemployment insurance payments, has been notifiedExemptions Are ListedHowever, there are exceptions which exclude-from “employment'’ specified classes of workers. The term employment” under the law does not include agricultural labor, servants in the home, service by certain close relatives, service performedthat the worker’s claim has been strictly for a reiigious, charitable,filed .and that it may apply against his reserve account.If the employer receiving such notice believes that the individualclaiming benefits should be held ineligible he files a protest with the division within seven days after the date of the claims notification.If an employer protests, the matter is investigated by the division. An agent makes a specific determination covering the protest and the employer is notified as to the findings. A notice of the determination also is mailed to him. The employer, if he chooses not to accept the determination, has the privilege of appealing. If he does this a hearing is held.Common Protest Reason*Most common reasons given by employers who file protests havebeen found to be:1—Where the employer believesthe claimant is not able or available for work, or is not actively seeking reemployment.2.—Where the claimant is aBeved to have quit his job voluntarily without good cause attributable to hisemployment.3_ where the worker has been discharged for misconduct In connection with his work.4.—Where the worker fails, to accept suitable employment withoutgood cause.5. Where the claimant is unemployed because of a stoppage of work which exists in ihe employer's plant due to a labor dispute.When an appeal is taken—either by a claimant or an employer—a date for nearing is set. The hearing is conducted in an informal manner before a referee who Ls a member of the division’s staff. The employer may appear in person, or he may be represented by agent or attorney, and he also may be assisted by any designated individual.After a written decision has been made by the referee, should the tie-scientific, literary, or educational organization, and various other less general types of service set out in the law.Where anyone has doubt as to the ‘‘employment’’ status of any of his workers it is advisable to present the matter to the division for a review and a specific ruling. This can be done by writing the central office of the division. Box 50. It is chiefly, for this reason that the division urges all employers to make inquiry as to their liability status and especially is this true where an individual purchases a business.Check Taxec When KeyingThere are Instances where the division has found a firm liable for as much as $6,000 in back taxes and penalties.
