MThe above defendants are notified that at the May Term, 1844, of said Court, the complainant filed his petit ion, praying among other tilings for an order of partition and side (in accordance with the provisions of the last will and testancnt of John Cummins, dec’d) of certain real estate in said county, situated in the north part of section 24, town. 4, entire range 1, of the Miami i ur chase, containing 219 acres, and being the homestead of the said John Cummins, deceased, and all the real estate of which he died seized, excepting a lot of 106100 acres, heretofore sold by the Executors of said John Cianmuis, .dec’d, to Philips.
