Washington, Ind. against Robert and j Mary E. Farnham of Cass, asking ! possession of nine-year-old Robert , Baty, a nephew of the plaintiffs and I the grandson of th* defendant. I j During the February term of the i circuit court Maurice and Pearl May j Baty were granted the custody of the( j child’s father, mother and his brotk-bov, Robert Bady on adoption. The brothers and sister* died during the influenza epidemic last fall and the grandparents took the boy into their' home. |They fought the case desiring to. 'adopt the child themselves. They' j refused to give up the boy to the, i Batys and the Habeas corpus pro-j ceedings just filed asks that they b3lt; t t; given the custody of the child im-1 mediately, having been legally given 1 the authority to adopt him.
