Wolfe stIN the Circuit Court No. 2of Baltimore City —(A 64—1904.)—Jan Sobus, plaintiff, vs. Maryanna Sobus et al., defendants.The object of this suit is to procure a decree striking out the words “and wife, Maryanna,” in the account book given plaintiff by the Kosciuszko Permanent Loan and Saving Association of Baltimore city; that said account be reformed in that particular; that the money deposited by plaintiff with said association belongs exclusively to him, and that it be paid to him,The bill states that the plaintiff made sundry deposits with said association, amounting in the aggregate to $165. That said deposits were his own money; that when he made the last deposit, amounting to $60, he caused to be written in the book of deposit “and wife, Maryanna;” that plaintiff ever since he made the first deposit has had said book in his exclusive possession; that the reason for inserting his wife’s name in said book was, in the event of his sickness, to enable him to withdraw sums of money as he might need during his sickness; that in October, 1903, he met with an accident, which destroyed the use of one of his legs; that on February 23rd, 1904, his wife abandoned him and their five young children (who are dependent on him for support), with one Joseph Wojtulewicz, known also as Joseph Wickles, with whom she is now living in adultery, out of this State, and that she is a non-resident of the State of Maryland; that plaintiff desires to withdraw said money from said association and has demanded the same but it refuses to pay, unless upon the order or decree of a court; that plaintiff never intended to make a gift of said money to his wife or in any manner to part with his absolute and exclusive right to it or to part with any interest or share therein.It is thereupon, this 24th day of March, 1904, ordered by the Circuit Court No. 2 of Baltimore city, that plaintiff, by causing a copy of this order to be inserted in some daily newspaper published in the city of Baltimore, once in each week, for four successive weeks, before the 25th day of April, 1904, give notice to said absent defendant of the object and substance of this bill,warning her to appear in this court, in person or by solicitor, on or before the 11th day of May, 1904, to show cause, if any she has, why a decree ought not to pass as prayed.GEORGE M.
