Cabot testified that he did not say anything of the sort, and this assertion was sustained by the statement of George Guernsey, his apprentice, who was present at the time. Dr. Pease stated that he made an examination of the face of the complainant about a week later than August 20, and that it then appeared to be in normal condition. It was impossible for him to say, however, that that had been its state a week previous. Dr. Miller’s testimony was merely to explain the nature of certain diseases of the skin. The evidence of Jacob Shull was a corroboration of what has been submitted by Messrs. Cabot and Guernsey, which was to the effect that on the day of the refusal, Porter had the appearance of a man afflicted with a skin dis* ease.
