The respondent resides at 2U0 Washington avenue, Charleroi.•*. .They • were married in Pittsburgh, July 17, 1930, and lived together . in Charleroi for three, months, ^when Brnssart avers that he learned that his wife already had a husband from whom she had not be divorced. According to Brassart’s statement she was married in North Charleroi, on March 4, 1925, to John B. Richir, who is now living at Yonkers, N. Y., but she has never been divorced front him.^. Cruel and barbarous treatment is charged by Mabel J. Phillips, oflips charges that her husband drank to excess and drove her from their home on the night of June 25, 1930. The following month he .was taken to St. Francis hospital, Pittsburgh, for a short time for treatment. On September 15, .1930, she avers he attacked her with a scre\y driver, and on Scp^tember 2*1, he attempted to assaulther with a knife.
