Roth men had failed to make alimony payments in accordance with the orders of the courtIn extenuation of his conduct Crea-ger stated that he had been injured in a wreck and was unable to work. Mrs. Creager's attorney stated thatCreager had received $300 from the W. L*. E. railroad In settlement ofa claim for damages. Creager stated that he had received $ 27.0 and that he had been unable to work for seven months.Judge Richards told Creager to go to some physician for examination and have the physician make a. rejyrf to the court. In the course of a half hour Creager reappeared in court withDr. A I.. Or born, the railway Mm-pany’s surgeon I)r Osborn stated that Creager had been injured as stated and that he had retarded full •and complete recovery by going to work too soon. The doctor's statements helped Creager out of his dilemma and the later was given another opportunity to meet the demand of the court,Creager filed suit for his wife for divorce, and she sued for alimony on cross petition. Creager’s petition was dismissed and Mrs Creager given alimony, last April, in the sum of $30 per month for ten months and after that $25 per month. Creager hasl*aid only $20 since the order wasmade.Just before John Pulley was called before the bar or justice. Hon. F. W.Van Du sen, his attorney, handed toAttorney S. M. Young, representingMrs. Pulley, the delinquent alimony.On the strength of the payment JudgeRichards passed the contempt charge against the defendant.John Konrad, who was sent to jailon a contempt charge, having failed to keep up his payments of alimony as ordered by the court, was brought in court at the instance of JudgeRichards Konrad was ordered to remain in jail until all back alimony had been paid.It was sore straits for Konrad the alimony bill becoming greater all the time with no prospects of paying it, and he sent word to Judge Richards that he would like a chance to show the court he was willing to work and keep up the payments.Judge Richards was disposed to comply with the request and informed Konrad that he would suspend the contempt sentence. He gve Konrad to understand, however, that failure to make the payments regularly wouldmean his reincarceration in the jail.
