Wife's Suit Dismissed and Husband Files Bill of Desertion. The divorce suit filed by Mrs. Stella PL Heitz against Charles 2B. Heitz was dismissed in the circuit court Tuesday following arguments on the motion to strike the case from the docket at the complain ant’s cost. The motion to dismiss was resisted by Mr. Heitz. Immediately following the court's ruling to the effect that the com plainant had the right to dismiss her bid, a separate action, asking for divorce on the ground of deser tion, was filed by Charles B. Heitz against his wife. The husband's bill asks for the custody of John P. Heitz, 15, who is residing with his mother. The latest divorce bill of the Heitzes sets forth that the couple was wed October 12, 1904, and be came estranged September 1, 1921. Mr. Heitz avers that his wife left him without reason and has de clined to consider a reconciliation. Mrs. Heitz had filed a bill to the June, 1923, term, charging deser tion and non-support and asking to retain the custody of the son. A cross bill was filed by the defend ant in which accusations were made, and in which the son's cs tody was asked by the father. The cause was continued, and the com plainant left for Chicago where she is employed at present. Mrs. Heitz instructed her lawyer to dismiss her action as she did not care to make the trip to Quincy to prose cute her suit. The motion to dis miss was resisted on the ground that the defendant to the first bill was ready to proceed to trial and had filed a cross bill. The suit filed by Mr. Heitz will proceed under a desertion charge and will be dock eted to the January term.
