The complaint states that the parties were married in January 18S4 while the plaintiff was viBiting friends in Kansas, and that in July of that year she learned that the defendant had a wife in California, and that he did not deny it when so charged by the plaintiff, but aaid that he would return to his other wife. Although the marriage of the plaintiff and defendant is illegal, the plaintiff desires the court to so decree.
