Case Will Be Contested When it Comes Up for Hearingz—Hus band Denies Desertion Charge. Charles Heitz has filed both an answer and a cross bill to his wife's petition for a divorce a on the ground of desertion and the case will be contested when it canes up for a hearing. Heir is represented by A. Hubbard and Ray Straith. Heitz has been unable to visit his son, John P. Heitz, now 14, who makes Tie home with his mother. Mr. Heitz denies the desertion charge and adds that for about Three months prior to the separa tion Mrs. Heitz had wholly ceased to live with her husband and persisted in a courge of conduct tending to drive time from his home. “She sel dom spoke to me except in anger,” the cross bill charges, Mrs. Heitz secured an order in the county court some time ago re quiring her husband to pay $8 a week for the support of the minor. In the bit for divorce that sum is specified as being inaderuate, Heitz makes answer to the effect that the wife is excessive in expenditures for the sons welfare and has formed associations of wealthy people for the boy which proves easily. Heitz adds that his income $58125 monthly and soon that he must pay $50 a month for the support of his mother. He contests the right of the petitioner to pray the court for an increase in the weekly alimony. The Heitzes were married October 2, 1904, according to Mrs. Kreitz's bill for divorce. The husband de clares it to be 6e year later.
