Temporary custody of two minor children was awarded Mrs. Joan Rookstool. 4519 N Shartel, Wednesday, pending her divorce action against her husband Paris Rookstool jr.Meanwhile, the county attorney’s office discovered that a charge of openly outraging public decency brought bv Rookstool against his wife and another man had been misfiled in a justice of the peace court and would ha\e to be refiled in common pleas court. 1Named in that action with Mrs. Rookstool was (ieorge Foster of Tulsa. IMrs. Rookstool filed suit for divorce on March Both partieshave been fighting for custody of ♦ heir two boys. Gary, 5, andMark. 2.Picture ExhibitedIn a district court hearing Tuesday, Mike Foster, attorney for Rookstool. exhibited a picture of Mrs. Rookstool and a man identified as Foster. The attorney said the picture was taken in a motel the night before Mrs. !Rookstool filed for divorce. Inthe photo, both parties are seated on a bod. Mrs. Rookstool hadremoved her shoes. IThe charges of openly out rag ing public decency and injuring public morals against Mrs. Rookstool and Foster are based on the picture evidence.I'nder questioning during the temporary custody hearing, Mrs. Rookstool admitted she had reg istered at the motel with the Tulsa man, hut declared she had railed him to discuss “my un j happiness at home.”Cruelty ChargedRooksfools attorney said the father of the youngsters pickedtip the two boys from a babysitter with whom Mrs. Rookstool had left them the night of March h while she allegedly went to the motel with the Tulsa man.In her divorce petition the following day, Mrs. Rookstoo1 charged her husband with extreme cruelty.District Judge Fred Daugherty,In awarding temporary custody of the children to the mother, said he found that the children have not been neglected or abused by Mrs. Rookstool.He added that in view of their fender years they should be with their mother and ordered the father to return the youngsters.Permanent custody will be determined during the divorce bearing, which has not yet been set for trial.
