I tain represents the defendant.The complaint alleges that he is no longer able to live with the defendant on account of her treatment of him, that she is very wasteful of food and clothing, refused at times to c ook for him and is disagreeable and unfriendly. They were married in May of 1881, lived together until May 2«j, 1912. and have one son, Scott. In February, 1907, Mrs. Deanfiled suit for a divorce and she alleges that she was induced to withdraw suit and return home and that on his promise to live peaceable withher she deeded him 20 acres of land on which is the home, bam and windmill, the home place known as the Dean farm in Green township. She alleges that she inherited 10 acres of this 20 from her father;that she borrowed money on theten to purchase another ten makingthe 20 acres mentioned.Mr. Dean was placed on the standand said that his wife was very wasteful, that she would throw much food out the window, purchase carpets not needed, buy clothes and said that after being on the farm all these years making $2.‘ to $60 per day iu w orking season, that he had i lt;only 26 cents in the bank now*. He spent his money on the farm, and mostly through his extravagant wife. There were* some notes yet unpaid jand he is in debt several hundred ! „dollars. *:He said that his wife drunk whisk-ey, hut young Kobertsou, a boy wIiom worked for Dean, later stated that j | her physician prescribed it for her and that Dean bought it for her. On several oc c asions liis wife failed to Uget the meals and three or four | ^ times threatened to get a divorce. I ^Young Kobertsou is now staying | ^with Dean. He testified for the plain j tiff, stating that Mrs. Dean frequent-j j Jy railed Dean vile names and did ] j not treat him as a good wife* should, j | He said that she srturk Dean on i j ole* occasion with a poker, and on J another with a stick of wood and! went at him another time with a idish Dean each* no special com*' plaint. Robertson said except to “shame her. jD.inuun Dean, a nephew of Stephen; stated that tin- home life of the* two contending parties was not pleasant and In* 1 ic| not believe that theycould ever live* pecaeabiy together as | man and wife. iThere are many witnesses and j tiie case* will he hard fought. Her j4 omplaint alleges that Stephen would •4-tirse her, heat her, lt;*fr., and ac cused ) her of spending money in foolish j law suits, which probably referred jto the* famous Dean-('ole case*. On i one occasion she recites he knocke4l j the telephone* off tin* wall so she j ^ couldn't use it. Kobertsou testified he took it off nicely without hurtingthe phone and removed it to the_ barn. Her complaint alleges tnaij^ Dean's reason for removing the phonej ^ was because* sin* talked too much.' jShe alleges that sin* worked for her own living by selling butter and »*ggs and supported herself and boy and helped to support ‘In* hired hands.
