at.yVVtedA rather singular case is up before tht* magistrates Dds afternoon. In November, 1877, Fannie Piuin gave birth to an illcgito mate child. Afterwards proceeding* were begun before ’squire ('oilins, against George Brock, for bastardy, be being charged withbeing the father of tin* child. He fore the ease came to trial Brock married the girl, and the case was dropped. After marrying the girl Brock immediately deserted her and has made no provision for the support of tin* child, and suit is now brought by Die wife against her husband, for bastardy.As ’squire lt;\Uin.s is needed its a witness by the defendant, a change of venue was taken, and the case sent to ’squire Iluckcby I where the matter will jikelv no tried thisevening.It will he remembered that an account of a similar proceeding in Monroe county, was pubtblu'd in Die axiutn somemonths ago. In that case the judge of the circuit court decided that mamage was no bar to the action for bastardy, and thatwhere the parties wi re married, and the husband loft his family, nod failed to provide for the child, an action would lie, and gave judgment against the defendant.The matter has never been Mettled hy the supreme court, and the case presents some novel questions for the lawyer* and courts to determine.
