She immediately left'him and the next grand-jury in this county returned an indictment against him charging him with bigamy. Hex was tried at the May term, 1903, but was discharged upon the ground that the indictment was not good because it was not returned in Washington county, where his second marriage oceured. It is this fraudulent marriage that the plaintiff now seeks to have annulled.
