Johnson has entered suit against the Baltimore OhioSouthwestern Railway company for the recovery of $129 97 in damages. In his petition Mr. Johnson alleges that on August 2. 1906, he delivered to the defendant at its depot in Canaan vilte, for shipment to Boston, Mass two bags of wool both of which were valued at $129 07, the defendant agreeing to carry the wool safely and deliver same as aforesaid for certain charges Plaintiff further alleges that the defendant did not safely carry and deliver the wood or any part thereof, but wrongfully, carelessly and negligently failed to do so, wherehv tin* wool was wholly lost to the plaintiff to his damage in the amount of $129.97 Plaintiff asks judgment for that sum. together with in tcrest from August 2. 1906. The couple wer*’ married on July 1, 1877, at Pomeroy. Ohio, hut now reside in Athena. They are the parents of five children who are; Kmina, age 27; Walter. 25; Vernie, 23, Kate. 21 and Frederick, 15.Kelley alleges that he always conducted himself towards his wife as atrue and faithful husband; that thedefendant was wilfully absent from him for more than three years last past and that she wholly disregarded j all of her marital vows.
