Anna J. Friend, j from the defendant. Nathan S. Friend.The Bill states that the plaintiff and defendant were married on January 13. 1935 in Garrett County. Maryland, and ! lived at different places in Allegany County ur.til on or about July 5, 1948 That ever since the marriage of the parties, the plaintiff has always been kind, chaste and affectionate wife and her entire conduct has always been above reproach; that I the defendant since his marriage to the plaintiff, and prior to tne filing of the Bill of Complaint in this case, has com-! nutted the crime of adultery and that the plaintiff has not lived nor cohabited with the defendant since July 5. 1948 That the said plaintiff has not condoned the defendant's adulterous conduct subsequent to the aforesaid date, that one child was born as a result of the marriage of the parties and the plaintiff seeks the custody of the said Infant child; that the plaintiff has been a resident of Allegany County, Maryland, for more than one year before the filing of the Bill of Complaint in this case and that the said defendanthas twice been returned non est in thiscase.After the return of two Summons “non est”, it is thereupon Ordered this 17th day of February, 1949. by the Circuit Court for Allegany County. Maryland, that the plaintiff, by causing a copy of thls|\ Order to be inserted in some newspaper in the City of Cumberland. Maryland, once in each of four successive weeks before the 22nd day of March. 1949. giving notice of the object and substance of this Bill to the said absent non-resident defendant warning him to be and appear in this Court in person or by solicitor on or before the 7th day of April. 1949. to show s cause, if any he may have, why a decree should not be passed as prayed.JOSEPH E.
