Damewood charged with issuing a fraudulent check in which Damewood waa acquitted, as a result of motion to instruct the Jury to return a verdict in favor of the defendant, which motion was sustained by Judge West, Damewood has brought suit against James C. and Guy Davis in which he asks damages in the sum of $20,000. In his complaint Damewood says that on or about Sept. 15. 1909, James C. Davis antonly, maliciously and without probable cause therefor, made and filed in the office of the clerk of the Boone circuit court an affidavit charging Damewood with issuing a fraudulent check, whereby Damewood obtained from Davis nine head of horses. Said affidavit was placed in the hands of the sheriff of Boone county and Davis accompanied the sheriff to Chicago, where Damewood then was, and caused the arrest of Damewood. He also says that Davis caused his incarceration in the police station at Chicago, where he was stripped of his clothing and th$ clothing searched by the police. Measurements were made of his body, and his picture taken and placed in the rogues’ gallery, where it yet remains. That he was brought to Lebanon and confined in the county jail until released upon a bond. That said cause was afterward called for trial in the Boone circuit court, and such proceedings were had as resulted in the dismissal of said affidavit without any trial whatever.
