Mead.—Robert Roberta, Esq., of counsel for the defendant in this eulfc, appeared before Judge Thompson in the City* Court thia morning,and made application to have the default opened for tho purpose of having a now triai. The case it will be remembered came up for trial about two weeks ago, and having been placed on tho Jury calendar and . not caHed during tho 4lrst three weeks of tho November term, D. P. Barnard, Esq., of counsel for tho plaintiff, moved to bavoit placed on the Equity calendar, which was dono, and the case caino up for trial, when tho defense alleged that thoy were not ready to prooecd. On this ground, therefore, an application has been mado for .a now trial, so Ibat tbo defendant may be put on the stand to give hia version of the unpleasantness, which resulted in a separation between himsolf and wife,Tho motion was granted by Judgo Thompson on defendant paying $160 alimony, together with tho costs of tho suit, and to continuo paying $10 a week alimonyuntil the case shall bo decided. :—«$»-TTTE ETSTTER -DIVORCE SUIT.
