Jayne Asks Decree and AlimonyCharges Cruelty and Seeks $6000 and Court CostsSuit for divorce was instituted in the Clay county district court Saturday by Mrs. Lena Jayne against Frank E. Jayne of Spencer on charges of cruel and inhuman treatment and asking aliinony amounting to $6,000 plus court costs and attorney fees of $600, the custody of her three children by a former marriage, and the use of her former name, Lena Verner.In the petition filed by Attorneys Lovrien and Rader, Mrs. Jayne sets forth numerous instances of alleged cruelty ranging from alleged threats to kill her to the frequent use of violent language. She also charges that Jayne has failed to provide for her support and that of the children and enumerates various incidental acts including an alleged failure of the defendant to pay funeral expenses or buy flowers for Edith May Verner, daughter of Mrs. Jayne, who was killed when she fell from an automobile last winter while returning from a dance at Langdon.Gets AttachmentIn the petition, Mrs. Jayne maintains her husband to be possessed of real estate valued at $17,600 and to be capable of earning $150 per month. She states her only property is an undivided one-half interest in a piece of Spencer property valued at $1,500 and ask3 $300 support money during the period of litigation.Saturday, Judge George A. Heald granted an attachment to Mrs. Jayne for $3,000 and $300 support money against the property of the defendant after she had stated he contemplated disposing of the property so as to defeat her petition.Mr. Jayne has been divorced on two previous occasions. His first wife, Mabel, whom he married in 1897 divorced him on charges of infidelity January 7, 1921. She was awarded $20 a month alimony for the support of their eight children.On December 13, 1923, he married a second time and his wife, Emma, deserted him in July, 1924, he securing a divorce on these grounds on January 21,1927. Shortly afterward, June 11, of the same year he married his present wife at Jackson, Minnesota.In connection with the attachment of the Jayne property, which Is part of the site for the new post office at Spencer, it 1b stated by attorneys that there will be no delay in turning that property over to the government. In the opinion of Attorney LeRoy Rader, who represent Mrs. Jayne, his client would be foolish not to consent to the sale of the property as it would be the only way she has of securing the money requested in her petition.
